INTRODUCTION

Volume one of Genealogical and Historical Records of Russell County and Southwest, Virginia Families is the result of eleven years of research in an attempt to trace my own family tree. And, because I happen to believe that today is grounded in yesterday, the past is part of the present. In the course of this research, many records pertaining to other families as well as my own have been obtained. Therefore, some of those records have been added to this volume with the thought in mind that it might help others trace their genealogy. If time permits, other records will be published in future volumes.

Several records in this compilation have been contributed by genealogist cousins I have met or with whom I have corresponded the past few years. Therefore, rather than attempt to name each individual here the name of the contributor will be placed in parenthesis preceding the records as they are presented. Comments by the author will also at times be in parenthesis and I stand ready to be corrected Where there are typographical or other errors.

In the early days of this country, both before and after the Revolutionary War, a personal property tax was paid by all males age 21 or over, and if the head of a household had sons age 16 but under 21, the number of sons in that household was listed by the person who went onto the land taking tithes. Therefore, the existing tax lists show the number of sons age 16 to 21 living in each household and the researcher can subtract 16 from the date the tithable list was made when the extra tithable appeared on the list and get the approximate date of birth of that son. Give or take a year or two if a daughter was firstborn, then one can in this manner compute an approximate date of marriage of the householder and approximate date of birth of the first extra tithable (son) and those who appear on that tax list thereafter. Where no other records are available this method has been used by the compiler in an effort to ascertain approximate dates of birth at least.

It is also important to note that from 1775 to 1778 all land had to be purchased through the Loyal Company and alt though the Loyal Company could survey the land and vest right to it in an individual it could not issue a title.

This remained the case until a land office was opened an the surveys sold by the Loyal Company were approved to have titles issued upon them in 1783. Thus, for a period of 30 years no one in the area had a title to his property. If he wanted to sell it he could not deed it to another, but he could use the method called "assigning" whereby the seller and the buyer could make the trade and it would be legal although not recorded in the courthouse. Therefore, many surveys carry the statement, "so-and-so assignee of so-and-so." Sometimes the name of several individuals

appear on the land survey when that land was sold several times Apparently, the first name on the survey was the first buyer. Quite often the land owner died before the and office opened in 1783. Then the oldest son laid claim to the land and the survey was made in his name. At least records indicate this in many cases. Other records also show that some had to prove they had bought land and sold it to certain individuals before that person could get a clear title. Such a case can be found in the genealogy of Samuel Evans of Washington County, Virginia beginning page 397 of this manuscript. After the death of Thomas Walker and Samuel Evans, the sons of Samuel Evans had to go into court and swear that their father had bought land from Walker in 1773 and then sold it to a man named Hagy before Hagy could get a clear title to the land, and before the estate of Thomas Walker could be settled. Such records are of help to the researcher but it doubtlessly caused those who could not prove ownership of the land to lose it.

American Antiquaran Society, 1931) pp. 33-34; Montgomery County Record of Plotts A, pp. 71-74, "The early settlers could not claim the land on which they lived because it previously had been granted to the Loyal Land Company. Many were entitled to grants as a result of service in the French and Indian War and began to agitate for a right to stake their claims where they lived, Finally, the Colonial Council decided on Dec. 16, 1773 that such claims could be made anywhere the and had not been cleared. Thus, in 1774, many frontiersmen were able to have their land surveyed and recorded.

Hening, Statutes, X, pp. 35-50; Draper MS 10DD114; Abernathy, Western Lands, pp. 224-225, "But those who did not have militia claims had to wait until after 1779 when the State Legislature established a land office for the first time. The legislature also provided that each squatter could claim 400 acres on which to live. In addition, he could obtain 1000 acres which was called a preemption right. If the preemption right could be found adjoining the original land of the settler, it could be anywhere there was vacant land."

Although the known progenitor of each of the families presented herein is definitely not the first on the genealogical chart, the author has presented each family record in the following manner in order to simplify the reading.

First on the list: First Generation.
second generation: 1-2: 2-2: 3-2: 4-2: 5-2: etc.
Third generations 1-3: 2-3: 3-3: 4-3 5-3: etc.
Fourth generations 1-4: 2-4: 3-4: 5-4: etc.
Fifth generations 1-5: 2-5: 3-5: 4-5: etc.

First number represents order of birth. However, sometimes the order of birth is not known and is numbered thusly for clarification. Second number represents generation.

CHAPTER ONE - The William Evans Family

THE WILLIAM EVANS FAMILY OF RUSSEL, COUNTY, VIRGINIA

Due to the loss of several early court records of Washington and Russell Counties, Virginia it is very difficult to trace this particular family farther back than the William Evans who resided in Russell County, Virginia, It is possible that he was related to one of the other Evans families of Washington County.

The earliest record of any William Evans in the county of Washington is: William and Andrew Evans were witnesses to the will of Samuel Bell, deceased, in 1780 and the executor was Samuel Evans. Note in following chapters on other Evans that there were two Andrew Evans in Washington County who served at the Battle of King's Mountain. One was a son of Samuel Evans. The other Andrew was four years older and born in Mecklenburg County, North Carolina.

1783, William Evans paid personal property tax in Captain William Russell's precinct.

Jan, 17, 1783, William Evans married Matty Ferrell, Washington County, Virginia. Minister, Simon Cockrell. A line titled "Comments" in the present day marriage record book of this county refers one to book so-and-so. Thus indicating that the original book which was burned during the Civil War possibly contained further information.

William Evans next paid tax Russell County, Virginia, 1787. Then his name completely disappears from present day Russell County, Virginia records. Since the first will book of

Russell County Virginia was also destroyed by fire, there is no way to ascertain whether William Evans possibly during the year 1787 or 1788. However, in can be that he did die sometime after paying this tax since his name does not appear on the tax list from thereon.

Martha Ferrell who is assumed to have been the mother-in-law of William Evans paid tax in Russell County, Virginia, Captain John Kinkead's district, 1786; the same district where William Evans paid tax in 1787, Thus indicating that Martha Ferrell, widow and Matty Ferrell who married William Evans were not the same. (See Ferrell genealogy. !!! I think this is NOT RIGHT, she is WIDOW to WILLIAM FERRELL and newly Married to EVANS or maybe she’s a double widow? !!)

1790 Martha Evans paid tax in William Webb's precinct, this same area in Russell County, Virginia. An indication that William Evans had possibly died since paying tax in 1787. A zero follows her name showing she had no male tithables age 16 or over. Then June 15, 1791 Martha Evans was again listed as above.

1792 Martha Evans listed two tithables above age sixteen. She owned nine horses at that time. Since Martha and William married in 1783 Martha would not have had a son age 16 or over in less than ten years, Therefore we can only assume that William Evans had been married previously or the tithables age 16 or over in the in 1792 were other relatives, (!!! Or they were our WILLIAMS children, Richard and JOHN !!!)

One Richard Evans paid per. prop, tax in Russell County in this same precinct 1794 through 1798 and there are no further records in his name. Thus one cannot help but wonder if perhaps this Richard Evan may have been a son of William Evans by an earlier marriage.

May 19, 1804, 1805 and 1806, Ferrell Evans, son of Martha and William Evans, paid tax, same district, Russell County, Virginia. He then possibly moved to that area of Kanawha County, Virginia that later became Cabell County. (The tax List for Kanawha County has not been checked by this compiler.) However, the name Ferrell Evans appears on the tax list of Cabell County, Virginia beginning in the year 1809 when that county was formed then off and on up through the year 1815. Sometime prior to 1820, Ferrell Evans moved to that area of Floyd County, Kentucky that became Pike County in 1821. His first survey was June 7, 1821, fifty acres on Fork of Sandy River, Floyd County, Kentucky. If Ferrell Evans resided on this fifty acres or if it was ever sold, the compiler did not locate a deed. Sept. 24, 1839 Ferrell Evans bought 150 acres , Pike County, Kentucky, Peter Fork of Blackberry Creek. Then on April 7, 1851, d. bk. C. page 440, Pike County, Ky., Ferrell and Phoebe Evans sold above 150 acres to Fleming Stafford, their son-in-law, for $200. A description of the boundary includes a tree standing in the gap at the head of Pound Mill Branch, a fork of Blackberry Creek. Blackberry Creek empties into Tug River just across the river from the present town of Matewan, W. Va.

In 1969, the author visited the above mentioned area, trying to locate the grave of Phoebe (Musick) Evans, the wife of Ferrell Evans, who was buried in the Ferrell Cemetery On Ferrell Branch near Matewan. The well-kept Ferrell cemetery was located but the older part of the cemetery which lies above the newer cemetery was so brush-grown that it was virtually impossible to determine the location of any graves. Following this disappointment, we crossed Tug River and drove up the Blackberry Creek Road, never realizing

until we reached the county seat at Pikeville, where I located the preceding deeds, that we had bypassed, and possibly crossed the very land where my grandfather had lived.

Feb. 2 1849, Ferrell Evans bought 250 acres on Tug River in Pike County, Kentucky. Then, on March 4, 1859, Ferrell Evans and wife Jane sold above 250 acres.

Until a second marriage of Ferrell Evans, 1855, was located at the Virginia State Archives, this compiler found it to difficult to explain the sale of land in Pike County, Kentucky by Ferrell Evans and wife Jane because my father had said that Phoebe (Musick) Evans died in 1860. Apparently, my father did not know of the second marriage of his grandfather or did not wish to mention the fact that there had been animosity toward the children of Ferrell Evans by the children of Jane (Puckett) Evans by her previous marriage. Thus the error in the author's first publication, The History of Five Southern Families.

Sometime prior to, or after the sale of the 250 acres on Tug River, Ferrell Evans and wife Jane moved to McDowell County, Virginia (now West Virginia) where two of his sons had also settled. Ferrell Evans name appears on the McDowell County, Virginia tax list in 1859 and on the 1860 census record. However, we find Jane Evans name listed on the 1860 tax record of that county. Therefore, Ferrell Evans apparently died sometime after the census was taken 1860. He lies buried in the Evans cemetery near Bradshaw, W. Va. Ferrell Evans served as Justice of the Peace in Pike County beginning in 1826 and was licensed to perform marriages in that county in 1829.

Until definite proof showing parents of Willian Evans can be found, William Evans will be considered as the first generation in this chapter. The 1840 Census Logan County, Virginia carries the name of Gabriel Riffe. Therefore, he and Martha probably married in that county.

Existing Minutes of the Regular Baptist Church (Primitive Baptist) show that Gabriel Riffe participated in the formation of many churches throughout several counties in the State of West Virginia and Kentucky. No marriage records of any of the children of Martha and Gabriel have been located by this author as of 1975.

The sale of his personal property is of record Russell Co., Virginia, May 16, 1863, and in the opinion of this writer, one of the greatest injustices ever practiced was the sale of personal and real property of a deceased husband. Thus taking from a widow that which was rightfully hers. Elexious M. Evans' widow also died during the Civil War, leaving their children for others to rear.
Personal property tax records show that Elexious M. Evans was in the county of Logan from 1850 - 1857. The following year he removed to the newly formed county of McDowell and according to another publication, became the second High Sheriff of that county.

OLD COURTHOUSE—This is a picture of the McDowell County Courthouse in 1902 when it was located at English, then called Perryville. The picture was taken by D. Beeson, now of Johnson City, Tenn. He mailed the photo to Mayor W. B. Swope of elch. Beeson said he was employed with the engineering department of U. S. Coal & Coke at Gary when the photo was taken. Apparently, Hammon William Evans met his future wife while visiting Musick and Ferrell relatives in Russell County. The Kellys, Musicks and Ferrells, all resided in the same general area. After their marriage, Hammon and Phoebe set up housekeeping in Pike County, Kentucky where their first six children were born. While residing in Pike County, Hammon served as surveyor of public roads in his district in 1854. By occupation he was a farmer and raised sheep.

Sometime prior to, or during the year 1859, Hammon removed to McDowell County, Virginia (now West Virginia), where he purchased four hundred acres of land.on March 7, 1859, The cost of the land was three hundred dollars and a horse not exceeding more than six years of age, said horse was to be worth one hundred dollars, One of the boundary lines joined land on which Elexious Musick Evans, brother of Hammon, lived. Thus we see that Elexious was the first to move to McDowell County.

When first I began my research on the Evans family, I wondered why my grandfather Hammon Evans did not record his land title until the year 1879, Then I studied the history of the State of West Virginia and learned the answer. Perhaps a brief recounting of portions of that history will prove of interest to others.

McDowell was formed from Tazewell County Virginia Feb. 20 1858. Its area is 533 Square miles, and the first session of County Court was held at Perryville, now English, 1858. For several years, the Commonwealth of Virginia had tried without much success to induce settlers to go into the section of the State and showed great leniency towards

those who homesteaded there in that they were not pushed to pay their taxes for a number of years. In 1859 there were only two hundred and eighty free holders in the county and only about one third of the land was placed on land the books for taxation, the remaining two thirds being held by the Commonwealth of Virginia and unentered. The lands held by private owners were assessed at twelve cents an acre.

McDowell and Pike Counties were very similar in that both were originally a nearly impenetrable forest of hemlock white oak and poplar and a tangled wilderness of rhododendron and laurel. Doubtlessly, the Evans were accustomed to the territory, having traveled up the Dry Fork River into Tazewell and Russell County area from whence Ferrell Evans came. The road through McDowell County today is the same route traveled by the Indians and the early pioneer.

Shortly after the Evans settled in McDowell County, they began to participate in county affairs as is evidenced by the fact that Elexious became High Sheriff. When the Mexican War broke out, Hammon volunteered under Captain Moses Ferrell and headed for Mexico. However, the war was over before they reached the battle scene. When Hammon applied pension in 1887, it was refused on the grounds that he had not taken part in the actual battle.

On February 13, 1861, the Virginia State Convention called for end reached a vote on ordinance of Secession from the United States. Then on May 23rd an election was held and the State voted to ratify the ordinance, but the counties in West Virginia cast about forty thousand votes against it. However, over seven thousand West Virginians

  entered the Confederate Army early in the war the Confederate raids in the State were continued until the close of war.

Shortly after the birth of his daughter, Phoebe, Hammon Evans left home to join the Confederate Forces and his eldest son Ferrell walked with him to the mouth of Hurricane Branch. Just as Ferrell turned to go back home, his father said to him, "Tell your mother to name the baby Phoebe."

Had Hammon Evans known of the heart breaking events while were to follow, he might have reconsidered. Two Union Home Guards which were a menace to the neighborhoods where families were known Confederates began operating in the counties of McDowell and Wyoming. There were no regular Confederate soldiers left in that section during the later part of the war and Union Home Guards committed several serious outrages against defenseless families. They stole horses, cattle, hogs, and any household plunder they could carry. Then made their escape as quickly as possible. The Evans family was among those who fell victim to a group of men masquerading under the title of Home Guard.

When Phoebe, wife of Hammon Evans, saw the group of men milling about a Stone wall below her house, she became suspicious and surmising their intention, hastily donned her best, black, taffata dress, a last gift from her mother, then an every-day dress over top of it to prevent it from being taken. But alas, this act proved fruitless. One of the first demands when the men forced their way into the house was that Phoebe remove the dress

or have it stripped from her body. Phoebe Evans was only five feet tall, and she had what has aptly been described as "chinquapin black" eyes which doubtlessly flashed in anger when she was forced to give up the dress.

Not only were the men methodical in their destruction of all the household goods of Hammon Evans. They enjoyed it. One smashed a grandfather clock against the floor, yanked out the weights and draped the cords around his shoulders while he danced about the room chanting, "Tick tock, grandfather's clock! Knock! Knock!"

Phoebe, the baby, was asleep on one of the beds when the covers were yanked off and had it not been for Ferrell who was standing nearby, the baby would have been dashed to the floor.

The men jerked the feather ticks and pillows from the beds. Slashed the cloth and strewed the contents throughout the house. Tossed everything that would burn into the fireplace. Then went outside and raced back and forth, strewing more feathers through the air. Meanwhile, whooping and laughing hilariously.

The leader of the group was Mack Puckett, a neighbor. Yet twenty years after the close of the Civil War, Elexious M. Evans, youngest son of Hammon, married Elizabeth Puckett, to daughter of Mack. Upon learning of her son's intention to marry the daughter of her one time enemy, Phoebe Evans walked the banks of the Dry Fork River wringing her hands and crying to the top of her voice. Eventually, she learned to forgive and love the woman her son had chosen.

On June 20, 1863, West Virginia became the thirty fifth State in the Union after ratifying 2 constitution by the vote of the people. However y McDowell County's Representative was not officially recognized at the Wheeling Convention.

One of the earliest measures taken by the West Virginia State government was an act in 1863 providing for the forfeiture of property belonging to the enemies of the State including those who had joined the Confederate Army. Property was seized in only a few instances however, because the citizens were usually unwilling to take advantage of the political disability of their neighbors.

On February 25, 1865, the legislature passed a voter's test act, requiring from all voters an oath that they had neither voluntarily borne arms against the United States nor aided those engaged in armed hostility against the United States. Fearing that the test oath was unconstitutional on March 1, the legislature proposed the following amendment. No person since the first day of June 1861 has given or shall give voluntary aid or assistance to the rebellion against the United States shall be a citizen of this state or be allowed to vote at any election held therein, unless he has volunteered into the military or naval service of the United States and has been or shall be honorably discharged therefrom.

The test oath was opposed on the ground that in most cases it operated against persons who had accepted the results of the Civil war and who claimed full recognition as citizens under President Lincoln’s amnesty proclamation.

In 1866, the legislature passed a registration law authorizing the government to appoint in each county, a registration board of three citizens who were given power to appoint the township registrars and to act as the court of appeals in all elections. It also concurred in the proposed “decitizenizing" amendment and in May 1866, the people voted for this amendment thereby disfranchising between ten and twenty thousand persons.

In 1870, Governor William E, Stevenson recommended that the legislature pass an amendment restoring the privileges of those who had been disfranchised by the 1866 amendment. The law was passed and it was ratified by a vote of the people by a majority of 17,223 and proclaimed by the Governor April 1871.

After the State Legislature passed the amendment restoring the privileges of those who had been disfranchised by the amendment of 1866, Hammon Evans held his first recorded office in McDowell County, West Virginia.

In September 1882, Hammon Evans filed suit in McDowell county Circuit Court to obtain a legal title to the 400 a. of land bought in 1859. He presented as evidence the written contract and a written receipt of payment dated Feb, 8, 1862 from one F. P. Spotts, the original owner of the land. Waldron and Spotts had both died meantime and their heirs were named in the suit.

After Hammon Evans title was perfected, a man by the name Max Landburg came down from Pennsylvania in 1855 and laid claim to all the land in that area on a representation

of a grant from the King of England. Most of the settlers who had not perfected title to their lands lost it to Landsburg and even today, the Evans property is one of the few remaining fee tracts on original patents in that area.

By the time Hammon Evans perfected title to his land, he owed over twenty years back taxes. On June 15, 1886, Hammon and Phoebe Evans deeded the above mentioned four hundred acres to their sons William K. and Elexious M. Quite often I have heard my father say that he dug ginseng roots for months on end in order to pay the back taxes.

Obituary of Hammon W. Evans


“Hammon W. Evans, one of the well known citizens of McDowell County, died at the home of his son, W. K. Evans, on the night of August 13, 1892. He retired to his bed in his usual health and was found dead the next morning and looked as if he had died in his sleep without a struggle. The deceased was born in Pike County, Kentucky, April 4, 1825. His father was one of the old pioneers of the Sandy River region. Hammon W. Evans was a volunteer in the Mexican War and was three months in actual service. He was also a soldier in the late War of the Rebellion on the Confederate side and served under Col. A. J. May. Hammon W. married Phoebe Kelly, a daughter of William Kelly of Russell County, Virginia. They raised a large family, six of whom preceded him to the other world. His wife and seven children survive him. Three sons and four daughters. They have arrived to man and womanhood and are all highly respected, Ferrell H. Evans, Esquire, is a prominent attorney and has held office of Attorney of the Commonwealth.

Evans is a farmer an a teacher in public schools and the youngest son Elexious is a minister in good standing in the Regular Baptist Church. The deceased was one the kindest and most humble, hospitable men in all of the country and had no enemies. He was a Primitive Baptist in his belief up to the time of his death. He lived and died an honorable and honored man. He held many offices trust in the county of his adoption. He was president of the County Court of McDowell County for two terms and school trustee. He was a kind and loving father and devoted to his family who now live in hope of being reunited with him in a world where parting will be no more."

Final Tribute to Judge Evans

Funeral services for the late Ferrell H. Evans, who died Thursday, September 13 at his home in West Williamson were held last Saturday afternoon at the home. Services were conducted by Reverend Mr. May of Pond Creek. Interment, in charge of the Masonic Fraternity, followed at the city cemetery. Judge Evans was 72 years of age, having been born December 11, 1851 at what is now the Mathew Hatfield home place near Rose Siding. He was the son of H. W. and Phoebe (Kelly) Evans, the latter a native of Russell County, Virginia. His grandfather was Ferrell Evans, a pioneer of this section who once lived opposite Rose Siding.

Educated in the common schools at Tazewell, Virginia, Judge Evans aspired to become a lawyer but found his pathway strewn with many difficulties. His father and grandfather moved to Dry Fork, McDowell County. Both are buried there near Bradshaw. Judge Evans was compelled to work at manual labor when a youth and helped hew logs for the courthouse at Perryville, the first county seat of McDowell. He worked for fifty cents a day and studied law at nights. During his early student days, he poured over Blackstone in the office of Arch Perry, a famous lawyer and cattleman in his day. Judge Evans was at one time a law partner of Judge W. A. Ayers of Lebanon, Virginia.

In 1874, Judge Evans moved to Pocahontas County but returned in 1876 to Grundy, Virginia where he worked on a sawmill until he was licensed to practice law. He was twice elected prosecuting attorney of Buchanan County, and remained at Grundy until 1898, moving to Iaegar, a central point to practice

his profession at Welch, Grundy and Williamson.

Judge Evans moved to Williamson in 1900 and soon became one of the leading lawyers and citizens of the county. He was married to Mary Stacey in 1873.

Representing Mingo County as delegate in the legislature for two terms about 1904-1908, Judge Evans attracted State-wide attention. He was not only a prominent candidate for Speaker of the House, but one of its forceful members. Although elected as a Republican, he startled his party leaders by introducing and advocating a "Jim-Crow" bill precipitated a memorable fight.

Judge Evans legislative career was further distinguished by an act he was instrumental in having enacted into law ending the then common practice of using the name of State in land suits growing out of the King Patent, covering hundreds of thousands of acres of valuable coal land in Southern West Virginia. The act practically ended litigation arising from the King Patent.

Judge Evans was a man of iron constitution, strong and hardy until just a few years ago. He was kindly and courtly and his purse was always open to his friends. He had many very excellent traits of character and was greatly admired and liked by people throughout his section. At the bar, he was wonderfully successful, and enjoyed an extensive practice. He made a specialty of the criminal side of the law and appeared as counsel in more homicide cases than any lawyer in the State. It was his claim that he took part either for defense or the State in as many as three

hundred cases. For many years, few murder cases were tried in Mingo County in which Judge Evans did not appeal as counsel and he was often called to other counties in this state and the States of Virginia and Kentucky. Some of the trials in which Judge Evans took part are notable events in the history of this section.

Besides his wife, Judge Evans is survived by the following children, Alex, who is employed at the State Penitentiary at Moundsville. W. K. of Lewisburg. Mrs. C. H. Hinton Columbus, Ohio and John of Moundsville. Two sons, Ayers and Lawerence preceded him to the grave. He is also survived by the following brothers and sisters, Mrs. Matilda Cyphers of Coeburn, Virginia, Mrs. Nancy Roberts of BradShaw, W. Va., Mrs. Dan Kennedy of Bradshaw, Mrs. Mary Roberts of Lindsey and E. M. Evans of Honaker, Virginia.

Judge Evans had been a member of the Baptist Church for Many years, having been baptized into the faith by his brother, E. M. Evans.

Tribute was paid to a late Ferrell H. Evans by the legal profession Mingo County Bar Association in the following resolutions drafted by Attorneys S. D, Stokes, John L Stafford and Wells Goodykoonz: “Whereas, it pleaseth God to remove from this world Honorable Ferrell Evans in the seventy-third year of his life, we, the members of the legal profession of the Mingo County Bar Association of which he was a member, bow in humble submission to the All-

mighty command, but feeling deeply the loss of our deceased brother lawyer, we desire to testify and make it a permanent record by resolving as follows: " Ferrell H. Evans was a man, at the time of his death, full ripe in the knowledge of the law, of which profession he had been actively engaged for fifty two years. He never forgot that the first duty he owed was to society, and his continuous and earnest efforts were ever put forth to uphold law and justice. He was a man generous and full of kindness, ever ready and willing to advocate the cause of the weak, the poor and oppressed, money compensation being secondary consideration in the practice of his profession. His kind help and suggestions to those not so learned in the law as he will ever be remembered by the ones to whom he gave it. The work that he did in vindicating the right of the poor and needy will ever live as a monument, and his influence on society as an outspoken, ever-ready advocate of Justice on account of his demise, will be missed and the legal profession has sustained a great loss of one of its most able and brilliant members. Be it therefore, further resolved, that as a Memorial these resolutions be extended upon the Law Record of the Circuit Court of Mingo County. That copy under the seal of the Court be transmitted to his immediate family and that they also be published in the Mingo Republican."

Hammon Ayers Evans was a newspaper lineatype operator and occasionally filled the position of reporter and editor as well. While thus employed, Ayers wrote a great number of outdoor articles and short stories which were published. One of those stories which doubtlessly was related to him by his father entitled "An Old Time Shooting Match" can be found in this author's first publication, The History of Five Southern Families.

Ferrell joined the Royal Canadian Air Force prior to to the United States entering World War II. He flew "Spitfire” fighter planes in the defense of London. Then transferred

to the 8th Air Force. He was a pilot in "B-17 Bomber" and his plane was one of the lucky ones to survive the famous raid on the ball bearing plant at Stuttgart, Germany when the United States lost seventy five percent of their aircraft. Ferrell has several medals from the French, British and United States governments, one being the Purple Heart. Following his twenty five missions without fighter escort, Ferrell returned to the United States and was an instructor at Rapid City, South Dakota until the close of the war. He is presently a rural mail carrier at Johnstown, Ohio.

Lawerence was educated in the public schools and was preparing himself for the practice of law, having been a student at Columbus, Ohio at his untimely death. According to a newspaper article taken from a Williamson, West Virginia newspaper and heretofore copied in full in "The History of Five Southern Families", Lawerence Evans death occurred two days after being struck on the head with a whiskey bottle which was thrown by one Columbus Elswick after Lawerence had struck Tom Elswick, brother of Columbus, who had accosted and struck the Evans' housekeeper while they were attending a carnival.

Lawerence Evans was of a quiet disposition and never the aggressor in any trouble.

Although Elexious Musick Evans had no public schooling he was a self-educated man who, at the time of his death, had an education comparable to a High School education in many subjects and on beyond in others. His knowledge of the Bible was such that he could quote it almost word for word. He was also an astute business-man and knew almost as much law as many lawyers of his time. He was president of the

Sandy River District School Board of McDowell County, West Virginia; served as deputy sheriff, McDowell County; post-master at Lex, West Virginia, a mining camp named for him; Tax Assessor of the Sandy River District 1901-1904 and the first president of the Farmers and Miners Bank of Honaker, Virginia.

Elexious (spelled Electious originally and possibly changed to the other spelling due to lack of knowledge of correct spelling) is found spelled various ways in the early records. It was later shortened to "Leck". The name Evans is also often spelled "Evins" in early records and was pronounced "Evins" when my father was a young man.

Elexious "Leck" Evans was baptized April 1, 1888; Licensed to preach May 15, 1889 by Elder David Davis, Wallace Compton and S. H, Auvil at Bee Branch Regular Baptist Church, McDowell County, West Virginia and continued this ministry until his death.

Countless people came to the home of Leck Evans for food and lodging and no one was ever turned away regardless of his Station in life. Even now, I sometimes wonder if perhaps each hobo told the other that he could obtain free food and a place to sleep if he was ever in the vicinity of our home. Sometimes we had a hearty laugh when someone seeking lodging for the night said “ he was a Baptist.”

When he felt that he was right, Leck Evans could also be adamant as many learned to their sorrow and he rarely compromised in his beliefs. Yet, friend or foe received his help when in need.

The story of his call to preach was included in the first book published by this author. Nevertheless, it is again written here because it is a story that bears repeating,

As I approach the telling of the most momentous event in the life of Elexious Evans I fear that I will be unable to describe the scene as forcibly as he recounted it. My father was a man called of God and he preached with all the fervor of that calling. I have seen him preach so hard and so long that he eased his aching muscles by resting, a hand on his thigh as he leaned toward the congregation. He wielded his Bible like a pointing finger and when he warmed up, out came his handkerchief to wipe the perspiration from his brow. His face was imperious and noble, and his inspired eyes looked straight into those of his listeners. Now and then, he tilted his head heavenward and cried out with a loud voice just as he must have done on that day in 1888 when he met Jesus Christ face to face. I need not even close my eyes to evoke a picture of him as he told that immediate, tangible experience,

Early in life, at about the age of twenty-six, Leck Evans became obsessed and moved by the power of God to go into all the world and preach the gospel. He was so miraculously affected by this Invisible Power that was urging him to preach that even his wife and friends believed him to be insane and posted guards to watch him.

One day, Leck's brother William came riding by Leck's cabin on horseback and stopped for a moment to talk. William spoke in a rather foreboding voice as he said, "Leck if you don't stop this foolish talk about preaching and go

work, these children of yours will starve.”

With the warning words of his brother ringing in his ears, Leck walked slowly, as if bearing a heavy load, up the hillside to a strip of "newground" which he was clearing for cultivation. Nevertheless, his soul was burdened and his heart was heavy with the Power that possessed him. He often related in the pulpit, that on this occasion, he began to cut timbers and carry them down the hill and at every step something within him seemed to say, "You must go! You must go!" Darkness had clouded Leck's being, and an invisible power, with which he wrestled and pleaded, possessed him and he could not shake himself free. He said that he cast himself face first into a thicket of briars and cried, "Lord, I know I am wicked, undone and unworthy to bear your name. What would you have me do?"

Leck Evans lay in that prostrate position, in what he described as total darkness, oblivious, and unconscious of the fact as to whether he was living or dead. Slowly, consciousness crept upon him and awakened him to the realization that the terrible burden still persisted and weighed on him and he arose to proceed with his work. Dazed and in a semi-conscious state, Leck bore one log, then a second one down to the place where he was depositing them. While bearing a third log down the hillside, a cross came descending down out of the heavens and upon it was nailed he described as "The prettiest man I ever saw, and a thunderous voice said, "This is my cross which you must bear.”

Frightened and trembling from having witnessed such an

unspeakable vision, Leck Evans immediately broke and ran, crying, "Lord, deliver me from this burden!" He loped full speed down the hill toward the log cabin and his wife, who had been observing him, stepped into the path to stop him. As Leck came to a halt, he gasped, "Lizzy, I must preach or die!"

"Then, go and preach", she replied. "Let's get into the house and make preparations."

While his wife was preparing his clothes, Leck lay down across the bed. Immediately, he fell into a trance and saw a great vision. A host of people, clothed in lily-white robes, whose ranks extended beyond the span of the human eye, came marching down a fragrant, green valley, illuminated with a radiant light. Leading this great army, was a man by the name of Wallace Compton who was a Baptist minister. As they came marching through that narrow valley, festooned in awesome beauty, voices became faintly audible. Closer and closer it drew until the voices broke forth into a melody of words which could be heard. There is a fountain filled with blood, drawn from Emmanuel's veins, rang out through the valley. Then came a pervading hush and the voices faded to a low and tender tone as if a mighty symphony had suddenly reduced to low amplitude, and the same stirring, commanding voice that had spoken to Leck Evans in his other vision said, "This is the church: Go join its ranks."

Leck awoke out of this beautiful vision shaken by incredulity, not knowing whether to believe himself alive, dead, or dreaming. As his wife presented his neatly pressed trousers, he became revived from his dazed condition and

realized that he had just witnessed was a great revelation. He described the vision to this wife and declared his intention of crossing mountain into Virginia to locate Wallace Compton whom he had seen in the vision.

Leck bade his wife and children farewell and mounted his mule, his only means of transportation at that time, and began his journey which was to take twelve hours.

On arriving at the home of Wallace Compton, Leck recounted the awesome story, and in the presence of a few neighbors, Wallace baptized Elexious Musick Evans "to arise from the watery grave" to become one of the greatest preachers and crusaders for Jesus Christ that West Virginia Virginia, Kentucky and parts of Tennessee and Ohio has ever seen.

It is impossible for one to disbelieve the story of this man’s religious experience. He devoted his entire life to preaching the gospel without receiving a penny to compensate him for his efforts. He often stated that God rewarded him daily for his ministry, and that he had been as happy while preaching as he would be when he got to heaven.

(b. Jan. 9, 1828, Logan Co., Va.), son of Humphrey and Martha (Smith) Trent. Smith Trent first married Mary Cline a had three children. After the death of Phoebe (Evans) Trent Smith Trent 3rd m. Rebecca Lambert, 1876 in Lawrence Co., O. Smith Trent served as High Sheriff of McDowell Co., W. Va. six years, the first term as fourth sheriff of that county, four years as constable and two years as deputy sheriff in Logan County. He was also a farmer and veterinary surgeon while residing in Wayne Co., W. Va. during the late 1870's.
